1. Scope of Application
These General Terms and Conditions apply to all orders placed through our online shop by consumers and entrepreneurs. Consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. Entrepreneur is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity. Against entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to them.
2. Contracting Parties, Conclusion of Contract, Correction Options
The purchase contract is concluded with B+F Schmierstoff GmbH.
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to submit an offer. You can initially place our products in the shopping cart and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. By clicking the order button, you make a binding offer regarding the products in the shopping cart. The confirmation of receipt of your order occurs immediately after the order is sent. We accept your offer within two days by sending a confirmation of acceptance in a separate email or, if applicable, by executing the payment transaction through our service provider or the selected payment service provider. The timing of the payment transaction depends on the selected payment method (see under "Payment"). The relevant alternative for you depends on which of the listed events occurs first.

We store the contract text and send you the order data and our GTC in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Subject Matter of the Contract

Without prejudice to your statutory warranty rights, we would like to draw your attention to the following special features. If in doubt, please contact us: Due to individual screen configurations (e.g., resolution and brightness), slight deviations between the displayed and actual product colors are possible.
5. Delivery Conditions
5.1 Delivery Options
We ship the products to the delivery address specified in the order process.
You generally have the option of picking up at B+F Schmierstoff GmbH, Am Gewerbehof 13, 50170, Kerpen during the following business hours: 08:30 - 16:00
5.2 Delivery by Freight Forwarder
Appointment Scheduling: For freight deliveries, the commissioned freight company will contact you to arrange a delivery date.
Delivery Location: The delivery of the goods involves transporting and unloading the goods at the first public curb of the agreed delivery address. The delivery does not include delivery into specific rooms or assembly and/or installation of the ordered goods unless explicitly agreed otherwise.
Required Site Conditions: Delivery by freight is only possible if the delivery address can be reached by motor vehicles with a permissible total weight of 40 tons on public roads with a minimum width of 3.50 meters without further official or civil restrictions. The product must be transportable by two persons to the agreed delivery location (especially regarding doors, stairs, staircases, etc.). Information on packaging dimensions can be found in the offers. If any of the above conditions are not met or if you have doubts, please contact us by phone before placing the order.
Recipient's Cooperation: Unloading and any necessary subsequent transport of the goods to the agreed delivery location are carried out jointly by the freight driver and the recipient. Information on packaging dimensions can be found in the offers. For merchants: The recipient is responsible for unloading and any subsequent transport of the goods to the agreed delivery location, contrary to the previous sentence.
6. Payment
6.1 Maturity and Default
The price is due upon conclusion of the contract unless a later date is specified in the following payment conditions. For consumers: In case of default, we reserve the right to charge a fee of 1.50 euros per reminder in the second and subsequent reminders. You are entitled to prove a lower damage. Further claims remain unaffected. For entrepreneurs: In case of default, we reserve the right to charge statutory default interest at nine percentage points above the base rate plus a flat rate of 40 euros. Further claims remain unaffected.
6.2 Payment Methods
Our shop generally offers the following payment methods.
Prepayment: When choosing the prepayment method, we will send you our bank details in a separate email and deliver the goods after receipt of payment.
Cash on Pickup: You pay the invoice amount in cash upon pickup.
PayPal Express: To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg, you must be registered with PayPal, log in with your access data, and confirm the payment instruction.
PayPal may offer registered and selected PayPal customers additional payment options in their account. We have no influence on offering these options; additional individually offered payment options relate to your legal relationship with PayPal. Further information can be found in your PayPal account.
PayPal Payments in Collaboration with PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg: We offer the following PayPal services as payment options. Unless otherwise specified, payment via PayPal does not require registration with PayPal. Further information is available during the respective payment option and the ordering process.
Purchase on Account via PayPal: The purchase on account via PayPal requires an address and credit check and is processed directly by PayPal.
7. Right of Withdrawal
You have the statutory right of withdrawal as described in the withdrawal policy.
8. Retention of Title
The product remains our property until full payment. For entrepreneurs: We reserve ownership of the product until all claims from ongoing business relationships are settled. You may resell the retained goods in the ordinary course of business; all claims from this resale are assigned to us in advance in the amount of the invoice amount, regardless of whether the goods are connected or mixed with a new item, and we accept this assignment. You remain authorized to collect these claims, but we may also collect them ourselves if you do not meet your payment obligations. The security interests we hold will be released upon your request insofar as the realizable value of the security exceeds the value of the open claims by more than 10%.
9. Transport Damage
For consumers: If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failing to make a complaint or contact us has no consequences for your statutory claims and their enforcement, especially your warranty rights. However, it helps us to assert our claims against the carrier or transport insurance.
10. Warranty and Guarantees
10.1 Defect Liability Rights: Unless expressly agreed otherwise below, the statutory defect liability rights apply.
The following restrictions and shortening of deadlines do not apply to claims caused by us, our legal representatives, or vicarious agents in cases of injury to life, body, or health, intentional or grossly negligent breach of duty, or fraudulent concealment of defects, or within the scope of product liability law. Restrictions for entrepreneurs: For new items, the warranty period for defect claims is one year from the transfer of risk. The previous sentence does not apply to items used in accordance with their usual purpose for a building and causing its defectiveness.
The statutory limitation periods for recourse claims according to § 445a BGB remain unaffected. Notice to merchants: Under § 377 HGB, merchants are obliged to inspect and notify defects. Failure to do so results in the goods being deemed approved unless the defect was not detectable during inspection. This does not apply if we have fraudulently concealed a defect.
10.2 Guarantees and Customer Service: Information on any additional guarantees and their specific conditions can be found with the product and on special information pages in the online shop.
11. Liability
We are liable without limitation for claims arising from damages caused by us, our legal representatives, or vicarious agents in cases of injury to life, body, or health, in cases of intentional or grossly negligent breach of duty, or within the scope of product liability law. For breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations), liability is limited to the foreseeable damage typical for the contract if caused by slight negligence. Otherwise, claims for damages are excluded.

13. Dispute Resolution
We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
14. Final Provisions
If you are an entrepreneur, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a merchant within the meaning of the Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships is our business location.
If individual clauses of these GTC are wholly or partially invalid, the remaining provisions remain unaffected. If individual clauses are invalid, the content of the contract is governed by the statutory provisions.
